Challenge to pending extradition proceedings dismissed as premature
✕
Summary
An Ugandan national sought revision of interlocutory rulings in pending extradition proceedings initiated at the request of the United States, where he is wanted to stand trial for narcotics, firearms and material-support offences. He challenged, among other matters, the form and authentication of the extradition documents, the procedure used to commence the proceedings, diplomatic immunity, the principle of speciality and the jurisdictional and constitutional basis of the request. The High Court held that the Magistrate had not finally determined most of those objections, but had reserved mixed questions of law and fact until after the evidential hearing. Since revision lies only against final orders, the application was dismissed as premature, the stay was vacated and the case was remitted to the Magistrates’ Court for completion.
