Extradition proceedings: duty to schedule a new hearing after receiving supplementary information from the requesting State
Summary
In extradition matters, if the Court of Appeal requests supplementary information, it must schedule a subsequent in camera hearing to examine and discuss the information received, in order to ensure adversarial proceedings between the parties. Accordingly, the judgment declaring the conditions for extradition to the Republic of Kosovo to be met must be set aside, on the ground that, once the results of the requested inquiries had been received, the Court of Appeal merely reserved its decision at the previous hearing and then issued its ruling—without hearing the parties.
