EAW issued for the purposes of prosecution and refusal ground based on social integration
Summary
Where a European Arrest Warrant has been issued for the purposes of prosecution — and not merely to carry out investigative activities — the need identified by the judicial authority of the issuing State cannot be satisfied through a mere occasional videoconference connection. Furthermore, in relation to this type of EAW, unlike the “executive” EAW governed by Article 18-bis(2) of Law No. 69 of 2005, paragraph 1 of that provision does not permit refusal of surrender on the basis of the requested person’s so-called “social integration” (“radicamento”) in Italy. Rather, Article 19(2) of the same law provides, as an alternative safeguard, only the possibility of making surrender conditional upon the person being returned to Italy, following the conclusion of the foreign proceedings and in the event of conviction, for the enforcement of the sentence imposed.
